A maioria desses incentivos &eacute; relativa ao Imposto sobre Circula&ccedil;&atilde;o de Mercadorias e Servi&ccedil;os (ICMS).<\/p>\n<p>&#8220;A convalida&ccedil;&atilde;o dos incentivos fiscais evitar&aacute; que empresas que usufru&iacute;am de benef&iacute;cios legitimamente concedidos pelos estados sejam surpreendidas por uma d&iacute;vida tribut&aacute;ria impag&aacute;vel&#8221;, afirma o gerente-executivo de Pol&iacute;tica Econ&ocirc;mica da Confedera&ccedil;&atilde;o Nacional da Ind&uacute;stria (CNI), Fl&aacute;vio Castelo Branco. &#8220;A d&iacute;vida gerada pela extin&ccedil;&atilde;o dos benef&iacute;cios compromete a sobreviv&ecirc;ncia das empresas e amea&ccedil;a a economia de diversos munic&iacute;pios&#8221;, completa Castelo Branco.<\/p>\n<p>A CNI alerta que, caso o projeto n&atilde;o seja aprovado, os incentivos fiscais podem ser declarados inconstitucionais pelo Supremo Tribunal Federal (STF).&nbsp; Neste caso, as empresas que j&aacute; pagaram os impostos observando as regras acordadas com os estados ter&atilde;o de ressarcir os cofres p&uacute;blicos com a diferen&ccedil;a entre o imposto recolhido e o efetivamente devido. A cobran&ccedil;a desta d&iacute;vida inesperada compromete as opera&ccedil;&otilde;es de muitas empresas e aumenta a inseguran&ccedil;a jur&iacute;dica do investidor.&nbsp;&nbsp;&nbsp;<\/p>\n<p>A extin&ccedil;&atilde;o imediata dos incentivos reduzir&aacute; a rentabilidade prevista dos investimentos, o que inviabilizar&aacute; muitos projetos.
